Terms of Service

Important: By accessing and using Wayven, you agree to
all the terms and conditions described in this document. If you do not
agree with any of these terms, you must not use our platform.
1. Acceptance of Terms
By creating an account and using Wayven, you agree to be bound by these
Terms of Service, our Privacy Policy, and all applicable laws and
regulations. If you do not agree with any of these terms, you are
prohibited from using or accessing this platform.
We reserve the right to modify these terms at any time. Changes will
become effective immediately upon posting on the platform. Your
continued use after changes constitutes acceptance of the new terms.
2. Description of Service
Wayven is a digital platform for travel planning that allows users to
organize trips, create checklists, store documents, and receive
AI-powered suggestions. We provide technological tools to assist in
planning, but we are not a travel agency and do not sell travel products
directly.
2.1 What We Provide
- Digital tools for travel planning and organization
- Secure cloud storage for travel documents
- AI-powered suggestions based on your preferences

Integration with third-party services (Google Places, Unsplash,
Viator)
- Mobile and web applications
2.2 What We Do NOT Provide
- Sale of airline tickets, hotels, or tours
- Travel insurance
- Visa consultation or immigration advice

Guarantees about availability or prices of services from third parties
- Financial or legal advice related to travel
2.3 Plans and Access Tiers
Wayven offers different usage plans:

Free Plan: Access to core features with usage limits:
- Up to 1 active trip at a time
- Up to 3 destinations per trip
- Up to 3 documents per trip

AI features available after watching a video ad ("Rewarded Ad"
model)
- Display of advertisements within the app

Pro Plan (subscription): Expanded access, including:
- Unlimited trips, destinations, and documents
- AI features without needing to watch ads
- Removal of all advertisements
- Additional smart notifications
Specific limits for each plan may be adjusted at any time. Wayven will
notify users of material changes with adequate notice.
3. User Account
To use Wayven, you must create an account by providing accurate and
complete information. You are solely responsible for maintaining the
confidentiality of your password and all activities that occur under
your account.
3.1 Registration Requirements
- Must be at least 18 years old
- Provide valid and up-to-date email address
- Create a secure password (minimum 8 characters)
- Agree to these Terms of Service and Privacy Policy
3.2 Account Responsibilities
- Keep your login credentials secure
- Notify us immediately of any unauthorized access
- Not share your account with others
- Maintain accurate and up-to-date information
- Not create multiple accounts without authorization
3.3 Account Suspension and Termination
We reserve the right to suspend or terminate your account at any time,
without prior notice, if we believe you have violated these terms.
Reasons for termination include, but are not limited to:
- Providing false information during registration
- Illegal or fraudulent use of the platform
- Harassment or abusive behavior towards other users or our team
- Attempts to compromise platform security
- Violation of intellectual property rights
- Prolonged inactivity (over 2 years without login)
4. Acceptable Use
You agree to use Wayven only for lawful purposes and in accordance with
these Terms. You must not use our platform in any way that could damage,
disable, overburden, or impair our servers or networks.
4.1 Prohibited Uses
You agree NOT to:

Use the platform for illegal activities or to promote illegal conduct
- Upload viruses, malware, or any malicious code
- Attempt to gain unauthorized access to any part of the platform
- Interfere with or disrupt the platform or servers
- Use automated scripts (bots, scrapers) without authorization

Copy, reproduce, or redistribute platform content without permission
- Impersonate other persons or entities
- Post offensive, defamatory, or discriminatory content
- Attempt to reverse engineer any part of the platform
- Use the platform to send spam or unsolicited messages
5. Intellectual Property
All intellectual property rights in Wayven, including but not limited to
design, source code, graphics, interface, and content, are owned by
Wayven or its licensors. You are granted a limited, non-exclusive,
non-transferable license to use the platform.
5.1 Platform Content
The following elements are protected by copyright and may not be used
without authorization:
- Wayven logo and brand
- Interface design and user experience
- Source code and algorithms
- Texts, images, and videos produced by Wayven
- Documentation and tutorials
5.2 User Content
You retain ownership of all content you upload to Wayven, including
travel plans, documents, and photos. By uploading content, you grant
Wayven a limited, non-exclusive, royalty-free, and revocable license to:

Service Operation: Store, transmit, display, and back
up your content to provide Wayven's features

AI Processing: Process your content using artificial
intelligence for document analysis, information extraction, and
personalized suggestions, with your consent when using these features
-
Improvements and Statistics: Use aggregated and
anonymized data (that cannot identify you or your original content)
for service improvements and statistics
This license remains in effect while your account is active and
terminates when you delete the content or your account, except for
backup copies that will be removed in accordance with our
Privacy Policy. Wayven will not sell,
sublicense, or transfer your personal content to third parties.
You represent and warrant that you own or have the necessary rights to
all content you upload and that such content does not violate
third-party rights.
6. Plans, Fees, and Payments
6.1 Available Plans
Wayven offers the following plans:

Free Plan: Access to core features with the limits
described in Section 2.3, supported by advertisements as described in
Section 7

Pro Plan: Subscription that removes usage limits,
eliminates advertisements, and unlocks expanded features as described
in Section 2.3
Wayven may offer additional plans in the future with differentiated
features. Plan details, including pricing and benefits, are always
available on the subscription screens within the app.
6.2 Payment Processing

Subscriptions are purchased and processed exclusively through the
Apple App Store (iOS) or
Google Play Store (Android), depending on your device
platform

Prices are displayed in your app store's local currency and include
applicable taxes as determined by the respective store

Wayven uses RevenueCat as an intermediary platform
for subscription management and payment status synchronization

Your payment details (credit card, banking information) are processed
by Apple or Google — Wayven does not have access to
this data
6.3 Subscriptions and Auto-Renewal

Pro subscriptions are automatically renewed at the end of each billing
period (monthly or annual), unless cancelled in advance by the user

Cancellation can be done at any time through the subscription settings
of the Apple App Store or Google Play Store

Upon cancellation, you will retain access to Pro features until the
end of the current paid period

After the paid period ends, your account will revert to the Free Plan.
Content that exceeds Free Plan limits will remain stored, but creating
new items beyond the limit will be restricted until you reduce usage
or resubscribe

Renewal is charged by Apple or Google 24 hours before the end of the
current period, in accordance with the respective store's policy
6.4 Refund Policy

Refunds for subscriptions purchased via the Apple App Store are
subject to
Apple's refund policy

Refunds for subscriptions purchased via Google Play are subject to
Google's refund policy

Wayven does not process refunds directly — all requests must be made
through the respective app store

In case of proven billing errors, Wayven will assist in resolving the
issue with the corresponding app store
6.5 Price Changes
Wayven may change the prices of paid plans at any time. Price changes:
- Do not affect the current billing period
- Will apply from the next renewal

Will be communicated by the respective app store in accordance with
its policies, before taking effect

Failure to cancel before renewal at the new price will be considered
acceptance of the new pricing
6.6 Affiliate Links
Wayven may include affiliate links to third-party services (hotels,
tours, flights). If you purchase through these links, we may receive a
commission at no additional cost to you. This does not affect the price
you pay.
7. Third-Party Services
Wayven integrates with various third-party services to enhance your
experience. These services have their own terms and privacy policies,
which you should review.
7.1 Integrated Services

Google Places API: For location information and
recommendations
- Unsplash: For destination photos
- Viator: For tour and activity suggestions

OpenAI: For AI-powered suggestions and document
analysis

Google AdMob: For displaying advertisements (Free
Plan only)
- RevenueCat: For subscription management
7.2 Artificial Intelligence and Automated Decisions
Wayven uses artificial intelligence (via OpenAI GPT and similar models)
for the following features:

Document Analysis: Automatic extraction of
information from tickets, vouchers, and reservations

Personalized Suggestions: Travel tips, checklists,
and activity recommendations

Assisted Planning: Budget, itinerary, and
organization suggestions
IMPORTANT — About AI Results:

AI-generated results are auxiliary suggestions, not
binding decisions

You can always edit, correct, or discard any AI
result

AI does not make decisions about service access,
denial, or conditions

AI-generated information may contain inaccuracies and should be
verified

Wayven is not responsible for decisions made based on AI suggestions
Under Art. 20 of Brazil's LGPD (General Data Protection Law), you have
the right to request
review of decisions made solely on the basis of automated
processing
of personal data that affects your interests. To exercise this right,

7.3 Advertising
Wayven displays ads via Google AdMob and other advertising networks on
the Free Plan to support the service. When using Wayven
on the Free Plan, you agree that:

Ads (banners and rewarded videos) may be displayed in various areas of
the app

Some AI features require watching a video ad ("Rewarded Ad" model) to
be unlocked

Ads may be personalized based on your interests and behavior, as
detailed in our Privacy Policy
- Wayven does not control or endorse advertised products/services
- You are responsible for any interaction with advertisers
Pro Plan subscribers do not see advertisements.
Communications from Wayven itself (such as information about new
features or service notifications) are not considered ads under these
terms.

7.4 No Responsibility for Third Parties
Wayven is not responsible for:
- Availability of third-party services
- Accuracy of information provided by third parties

Prices, availability, or quality of services booked through third
parties
- Changes to third-party policies
- Disputes between you and third-party service providers
8. Limitation of Liability
IMPORTANT: Wayven is provided "as is" without
warranties of any kind. We do not guarantee that the platform will be
error-free, secure, or always available.
8.1 No Warranties
We disclaim all warranties, express or implied, including:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or completeness of information
- Uninterrupted or error-free service
8.2 Limitation of Damages
To the maximum extent permitted by law, Wayven shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- Damages resulting from use or inability to use the platform
- Damages related to third-party services
- Damages from unauthorized access to your account
Our total liability shall not exceed the greater of: (a) the amount you
paid to Wayven in the 12 months prior to the event giving rise to the
claim; or (b) R$100.00 (one hundred Brazilian reais) if you exclusively
use the Free Plan.
9. Indemnification
You agree to indemnify, defend, and hold harmless Wayven, its directors,
employees, and partners from any claims, losses, damages, or expenses
(including legal fees) arising from:
- Your violation of these Terms
- Your violation of third-party rights
- Your use of the platform
- Content you upload to the platform
- Disputes with other users
10. Data Backup and Loss
While we implement backup systems, we recommend keeping local copies of
important documents. Wayven is not responsible for loss of data due to:
- Technical failures
- Cyberattacks
- User error
- Account termination
- Force majeure events
11. Modifications to Service
We reserve the right to modify, suspend, or discontinue any aspect of
the platform at any time, with or without notice. We will not be liable
for any modification, suspension, or discontinuation of the service.
In case of permanent closure of the platform, we will provide at least
60 days' notice and allow users to export their data.
12. Applicable Law and Jurisdiction
These Terms are governed by Brazilian law. Any disputes shall be
resolved in the courts of São Paulo, Brazil, with express waiver of any
other jurisdiction, however privileged it may be.
For international users, local laws may also apply, but in case of
conflict, Brazilian law shall prevail to the maximum extent permitted by
local legislation.
13. Dispute Resolution
Before initiating legal proceedings, we encourage resolving disputes
amicably:

- We will investigate and respond within 15 business days
- If no resolution is reached, consider mediation
- As a last resort, proceed with legal action
14. Severability
If any provision of these Terms is deemed invalid or unenforceable, that
provision shall be limited or eliminated to the minimum extent
necessary, and the remaining provisions shall remain in full force and
effect.
15. Complete Agreement
These Terms, together with our Privacy Policy, constitute the entire
agreement between you and Wayven regarding use of the platform,
superseding any prior agreements.
16. No Waiver
Our failure to enforce any provision of these Terms shall not constitute
a waiver of that provision or any other provision. Waiver of any breach
shall not constitute waiver of subsequent breaches.
17. Assignment
You may not assign or transfer these Terms or your account to any third
party without our written consent. Wayven may assign these Terms to any
third party without restriction.
